Good to know

I’ve had a director penalty notice — how long do I have?

Not long, which is why these are worth acting on the day they arrive rather than the week after. A director penalty notice has a short statutory period, and what you can do about it depends on the type of notice and whether lodgements were made on time. Bring it to us straight away and we’ll tell you what options are actually still open.

Can I object to a land tax or duties assessment from the SRO?

Usually yes, and there is a time limit. Objections to State Revenue Office assessments — land tax, duties, payroll tax, the absentee owner surcharge and vacant residential land tax — run to a set deadline, and there is a further appeal path to VCAT if the objection is refused. The earlier you get advice, the more of that path is still available.

The ATO is auditing me. Do I need a lawyer or is my accountant enough?

Your accountant knows your numbers and should stay involved. A lawyer matters when the audit turns into an amended assessment, a penalty, or a dispute you may need to appeal — and for anything where legal professional privilege is worth having over the advice. Often the best result comes from the two working together.

I owe the ATO money I can’t pay. What can be done?

More than most people expect. Payment arrangements, remission of interest and penalties, and negotiating before enforcement starts are all on the table — and all of them get harder once a garnishee notice or a statutory demand has issued. Early is cheaper than late, every time.

What does the first consultation cost?

A fixed fee of $180 for 30 minutes or $275 for 60 minutes, agreed up front with no hourly surprises. If your matter needs ongoing work, your lawyer will quote you clearly before anything proceeds.
